Maryland probate overview
Montgomery County Probate
Probate estates for Rockville residents are administered through the Montgomery County Register of Wills.
Montgomery County has a unique probate court structure. Unlike most Maryland counties, Circuit Court judges serve as the Orphans' Court for Montgomery County. Probate administration begins with the Register of Wills, while contested matters, judicial probate proceedings, and other issues requiring court involvement are heard by the Orphans' Court. Certain estate and trust disputes may also proceed in the Circuit Court depending upon the claims asserted and the relief requested.
Because we regularly appear before the Register of Wills, the Orphans' Court, and the Circuit Court in Montgomery County, we understand both the procedural requirements and the practical issues that arise during estate administration and probate litigation.
Assets that typically pass outside probate in Maryland
- Property owned by a Revocable Living Trust
- Jointly owned property with rights of survivorship
- Retirement accounts with designated beneficiaries
- Life insurance payable to a named beneficiary
- Payable-on-Death (POD) and Transfer-on-Death (TOD) accounts
- Transfer-on-Death Deeds for Maryland real estate, when applicable
Probate Is More Than Filing Paperwork
Many people believe probate simply means filing a will with the court. In reality, serving as a Personal Representative carries significant legal responsibilities. A Personal Representative owes fiduciary duties to beneficiaries, must comply with strict legal requirements, and may be held personally liable for mistakes.
We assist Personal Representatives with every aspect of estate administration, including:
- Opening the estate and obtaining Letters of Administration
- Identifying and valuing estate assets
- Preparing and filing required probate documents
- Notifying heirs, beneficiaries, and creditors
- Reviewing and resolving creditor claims
- Preparing inventories and accountings
- Selling estate real estate
- Resolving deed and title issues
- Distributing estate assets
- Closing the estate properly under Maryland law
Most people serve as a Personal Representative only once in their lives. We help you understand your responsibilities, avoid unnecessary delays, and confidently administer the estate from beginning to end.
When Is Probate Required?
Not every asset becomes part of the probate estate.
Assets that commonly pass outside probate include:
- Property owned by a Revocable Living Trust
- Jointly owned property with rights of survivorship
- Retirement accounts with designated beneficiaries
- Life insurance payable to a named beneficiary
- Payable-on-Death (POD) and Transfer-on-Death (TOD) accounts
- Transfer-on-Death Deeds for Maryland real estate, when applicable
Probate generally applies to assets owned solely by the decedent that do not have a surviving joint owner, beneficiary designation, or trust ownership.
One of the first things we do is determine exactly which assets require probate and which do not. That analysis often saves families considerable time, expense, and confusion.
Estate Planning Can Prevent Many Probate Problems
One of the most common things we hear after probate is:
“I wish we had known this before.”
Probate often reveals planning opportunities that could have avoided unnecessary expense, delay, or conflict.
After helping families administer an estate, we frequently help them prepare comprehensive estate plans that may include:
- Revocable Living Trusts
- Last Will and Testament
- Durable Financial Powers of Attorney
- Advance Medical Directives
- Transfer-on-Death Deeds
- Maryland Estate Tax Planning
- Business Succession Planning
- Asset Protection Planning
Our goal is not simply to complete one probate case. It is to help your family avoid unnecessary legal problems in the future.
Full Estate Planning ServicesProbate Litigation
Not every estate can be resolved through agreement.
Questions concerning the validity of a will, the actions of a Personal Representative or trustee, ownership of estate property, creditor claims, or the rights of beneficiaries frequently require court intervention.
Depending on the nature of the dispute, probate litigation may proceed before the Orphans’ Court exercising its probate jurisdiction or before the Circuit Court when broader civil claims or other relief are involved. We represent Personal Representatives, trustees, beneficiaries, heirs, and interested parties throughout every stage of estate litigation.
Our probate litigation practice includes:
- Will contests
- Judicial probate proceedings
- Trust contests
- Removal of Personal Representatives
- Removal of Trustees
- Fiduciary misconduct
- Accounting disputes
- Breach of fiduciary duty
- Creditor litigation
- Ownership disputes involving estate property
- Declaratory judgment actions affecting estates and trusts
Every dispute requires both legal analysis and practical judgment. Sometimes litigation is unavoidable. Other times, a negotiated resolution protects family relationships while preserving estate assets. We help our clients choose the strategy that best serves their interests.
Small Estates and Modified Administration
Not every estate requires a lengthy probate proceeding.
Some Maryland estates qualify for simplified procedures, including Small Estate Administration or Modified Administration, which may reduce both the time and expense of administration.
We evaluate every estate at the outset to determine whether either option is available and explain the advantages and limitations of each.

Probate Problems We Help Solve
Every estate is different. While some administrations proceed smoothly, many encounter legal or practical roadblocks. Our practice focuses on identifying those issues early and developing effective solutions.
We regularly represent clients in matters involving:
Will Contests
We represent clients challenging or defending wills involving allegations of undue influence, lack of testamentary capacity, fraud, forgery, or improper execution.
Trust Disputes
We represent trustees and beneficiaries in disputes involving trust administration, interpretation of trust provisions, fiduciary duties, and trust assets.
Family Disputes
Unfortunately, grief often magnifies long-standing family disagreements. We assist families in resolving disputes involving inheritances, reimbursement claims, personal property, heirship, and beneficiary rights.
Personal Representative Representation
Whether you have questions about your fiduciary duties or someone has challenged your actions, we provide practical advice and vigorous representation throughout the administration process.
Creditor Claims
We evaluate creditor claims, negotiate disputed debts when appropriate, and defend estates against claims that should not be paid.
Selling Estate Real Estate
Many estates include a family home that must be sold before distributions can be made. We assist with deeds, title issues, contracts, settlement coordination, court approvals when required, and the proper distribution of sale proceeds.
Missing Heirs and Complex Family Trees
Determining who legally inherits is not always straightforward. We assist with heirship determinations, intestate succession issues, genealogical questions, and locating missing beneficiaries.
Out-of-State and International Estates
Many Maryland estates involve beneficiaries or assets located outside Maryland — or outside the United States. We regularly assist clients with multi-state estates, international heirs, foreign documents, and cross-border estate administration.
